COUNTER-CLAIM OF POLSKA ENERGIA – PIERWSZA KOMPANIA HANDLOWA SP. Z O.O. NOT PROCESSED FURTHER

The Management Board of the company operating under the business name Polenergia S.A. (“Issuer”) in reference to current report No. 10/2023 of 31 March 2023 and earlier current reports (No. 14/2015 of 23 March 2015, No. 24/2019 of 25 July 2019, No. 27/2019 of 21 August 2019, No. 54/2021 of  29 December 2021, No. 34/2022 of 17 November 2022), hereby reports that on 16 May 2023, the District Court in Gdańsk delivered a decision of 2 May 2023 to Amon Sp. z o.o. with its registered office in Łebcz (“Amon”), the Issuer’s subsidiary, in a case brought by Amon against Polska Energia – Pierwsza Kompania Handlowa Sp. z o.o. with its registered office in Warsaw (“PKH”). By means of the aforementioned decision, the District Court in Gdańsk decided not to process the counter-claim of PKH any further (the Issuer reported the submission of the counter-claim in current report No. 10/2023 of 31 March 2023). The basis for the issue of the decision by the District Court in Gdańsk is Art. 204 Par. 1 second sentence of the Code of Civil Procedure, which stipulates that the counter-claim can be brought not later than in response to a claim.
