The Management Board of Polenergia S.A. (the “Issuer”) in reference to the current report of the Issuer with No. 12/2018 hereby reports that on 29 December 2020, the Issuer’s subsidiaries, Amon Sp. z o.o. with its registered office in Łebcz (“Amon”) and Talia Sp. z o.o. with its registered office in Łebcz (“Talia”) submitted modifications in the petition against Tauron Polska Energia S.A. (“Tauron”), encompassing claims for indemnity which arose after 31 December 2017 to the District Court in Katowice, 14th Economic Division.
The basis for tortious liability for damages of Tauron is discontinuation of performance by Polska Energia – Pierwsza Kompania Handlowa Sp. z o.o. – a subsidiary of Tauron – of long-term sale agreements of electricity generated in renewable sources and long-term sale agreements of proprietary rights resulting from certificates of origin that confirmed generation of electricity in renewable sources concluded with Amon and Talia.
Pursuant to the modification, the claims for indemnity along with interest increased: in the case of Amon by PLN 30,648,880.04 and in the case of Talia by PLN 21,828,658.56.
